1. SCOPE OF APPLICATION
The following General Terms and Conditions (GTC) apply to all orders placed through our website. The offer on this website is directed exclusively at consumers residing in Switzerland (referred to as the “Customer”). A consumer is defined as an individual who maintains a business relationship with VALL’DOAIDO GmbH (referred to as VALL’DOAIDO). Orders in quantities not customary for household management may be refused without justification.
VALL’DOAIDO reserves the right to change these General Terms and Conditions at any time. The version of these GTC in effect at the time of the order is applicable and cannot be unilaterally changed for that order. Any terms and conditions of the customer that conflict with or deviate from these GTC will not be recognized. The operator of this website is VALL’DOAIDO.
2.INFORMATION ON THIS WEBSITE
VALL’DOAIDO contains information about products and services. We reserve the right to make changes to prices and product range, as well as technical changes. All information on VALL’DOAIDO (product descriptions, images, illustrations, films, dimensions, weights, technical specifications, accessory relationships, and other information) is for illustrative purposes and should be understood as approximate values and are not binding. In particular, they do not represent any guarantee of properties or warranties unless explicitly stated otherwise. VALL’DOAIDO makes every effort to ensure that all details and information on this website are correct, complete, up-to-date, and clearly presented, however, VALL’DOAIDO cannot expressly or implicitly guarantee this. All offers on this website are subject to change and should not be understood as a binding offer.VALL’DOAIDO cannot guarantee that the products listed will be available at the time the order is placed. Therefore, all information regarding availability and delivery times is without guarantee and may be changed at any time without prior notice.
3. PRICES
The sales prices indicated at VALL’DOAIDO represent the final prices and, unless otherwise stated, include the legal value-added tax and any other legal taxes, such as advance recycling fees (VRG). Prices are quoted net in Swiss francs (CHF).
Any shipping costs will be charged additionally, unless the order exceeds CHF 250.00, and must be paid by the customer. Shipping costs are shown separately in the ordering process.
VALL’DOAIDO reserves the right to make technical changes, errors, and printing errors.In particular, VALL’DOAIDO may make price changes at any time and without prior notice. Consulting and support services are not included in the sales prices.
4. CONTRACT CONCLUSION
The products and prices on this website are non-binding offers.
By placing an order through this website, including accepting these TCG, the customer submits a legally binding offer to conclude a contract. VALL’DOAIDO will then send an automatic order confirmation by email, confirming that the customer's offer has been received by VALL’DOAIDO. Orders placed are binding for the customer. Unless otherwise stated, there is no right of return or withdrawal.
The contract is concluded as soon as VALL’DOAIDO sends a declaration of acceptance by email confirming the dispatch of the ordered products or services.
Orders will only be delivered after full payment has been received (exception: delivery against invoice) and provided the goods are available. If it turns out that the ordered goods cannot be delivered or cannot be delivered in full, VALL’DOAIDO will have the right to not accept or only partially fulfill the order. In this case, VALL’DOAIDO will inform the customer by email. If the customer's payment has already been received by VALL’DOAIDO, the payment will be refunded in full or only the difference to the customer. If no payment has been made yet, the customer will be released from the payment obligation.
5. PAYMENT OPTIONS AND RETENTION OF TITLE
The customer has the payment options available as indicated in the order process.
VALL’DOAIDO reserves the right to exclude customers from individual payment options without giving reasons or to insist on advance payment.
In case of delayed payment by the customer, VALL’DOAIDO may charge default interest of 5% per annum and a reminder fee of a maximum of CHF 20.00 per reminder.
The products delivered to the customer will remain the property of VALL’DOAIDO until payment has been made in full.
6. DELIVERY, INSPECTION OBLIGATION, NOTIFICATION OF DEFECTS
Deliveries will be sent by mail or courier service to the address specified by the customer in the order.
VALL’DOAIDO will strive to keep delivery times as short as possible. However, any delivery times indicated in the order confirmation are non-binding. VALL’DOAIDO has the right to make partial deliveries. In this case, the customer will only be charged once for shipping costs.
The invoice will be sent, provided delivery against invoice is offered, at the discretion of VALL’DOAIDO, by email or by mail.If delivery cannot be completed or if the customer refuses to accept the delivery, VALL’DOAIDO may dissolve the contract after notifying the customer by email and observing a reasonable grace period, and in this case, may also charge the customer for the inconvenience costs.
The customer is obliged to inspect the delivered goods immediately upon receipt and to report any defects for which VALL’DOAIDO is responsible immediately in writing, by letter or email, to the address indicated in the form.
In this case, the return to VALL’DOAIDO will be at the customer's expense and risk. The customer must send the goods in their original packaging, complete with all accessories and together with the delivery note and a detailed description of the defects including photographs to the address indicated in the form.
If the inspection by VALL’DOAIDO reveals that the goods have no detectable defects or are not covered by the manufacturer's warranty, VALL’DOAIDO may charge the customer for the effort involved in returning the goods or for possible disposal.
7. CANCELLATION AND RETURN
According to Swiss law, the customer has no legal right of withdrawal or return. However, VALL’DOAIDO will make every effort to find the most satisfactory solution for any issues that may arise.
8. WARRANTY
VALL’DOAIDO will strive to provide its products with the highest quality. It is at the discretion of VALL’DOAIDO to provide the warranty through free repair, replacement of equal value, or refund of the purchase price. Other warranty rights are excluded.
The warranty does not cover normal wear and tear or the consequences of improper handling or damage by the customer or third parties, or defects attributable to external circumstances.
In the case of wine products, VALL’DOAIDO will take utmost care with these products in its possession, but will not be responsible for the condition of the wine, nor for the quality not meeting the Customer's expectations. According to the regulations of the Swiss wine trade association, spoiled wine bottles will only be replaced if the wine is Swiss or if it is foreign wine bottled in Switzerland.
Broken or cracked corks can always occur when opening bottles. However, this does not entitle the customer to exchange or return the purchased product.
Damaged corks can occur with all products (spirits and wines, etc).In the case of cork taint, the bottle must be returned to the address mentioned on the form (link). We will professionally verify the claim and send a replacement bottle if the claim is justified. A claim will not be accepted if more than 10cl is missing. Cork taint can be detected quickly, so each customer should briefly taste their wines and note any defects.
Rarities and old wines are excluded from any returns, exchanges, and warranties. The customer cannot claim any compensation.
VALL’DOAIDO cannot guarantee the timeliness, completeness, and accuracy of the data, as well as the constant or uninterrupted availability of the website, its functionalities, integrated hyperlinks, and other content.In particular, no representation or warranty is made that the use of the website will not infringe the rights of third parties that are not owned by VALL’DOAIDO.
9. LIABILITY
VALL’DOAIDO excludes any liability, regardless of its legal basis, as well as claims for compensation against VALL’DOAIDO and against any auxiliary persons and agents. In particular, VALL’DOAIDO shall not be liable for indirect and consequential damages, loss of profit, or other personal damages, material damages, and pure financial loss of the customer. Liability for damages caused by gross negligence or intent by the Seller remains reserved.
VALL’DOAIDO uses hyperlinks solely to facilitate the customer's access to other websites.A VALL’DOAIDO cannot know in detail the content of these web offers, nor assume responsibility or any other liability for the content of these websites.
10. PRIVACY POLICY
A VALL’DOAIDO may process and use the data recorded during the conclusion of the contract for the purpose of fulfilling the obligations arising from the purchase contract and for marketing purposes. The data necessary for the fulfillment of the service may also be transmitted to requested service partners (logistics partners) or other third parties. If individual clauses of the contract or clauses of the General Terms and Conditions are invalid, ineffective, void, or unenforceable, or become invalid or unenforceable after the conclusion of the contract, the validity of the rest of the contract shall remain unaffected. The invalid or unenforceable clauses shall be replaced by a valid and enforceable clause whose effects come closest to the economic objective pursued by the contracting parties with the invalid or unenforceable clause. The above provisions shall also apply in the event that the contract proves to be incomplete.
VALL’DOAIDO expressly reserves the right to amend these GTC at any time and to bring them into effect without prior notice.
12. YOUTH PROTECTION
According to legal regulations, wine cannot be sold to persons under 16 years of age, and spirits cannot be sold to persons under 18 years of age.By placing your order, you confirm that the information you have provided is correct and that you are entitled to make a purchase.
13. COURT OF JUSTICE
All legal relationships between VALL’DOAIDO and the customer shall be governed by Swiss law (excluding the United Nations Convention on Contracts for the International Sale of Goods - CISG, Vienna Sales Convention). The place of performance and the exclusive court of jurisdiction is Balsthal.
