1. SCOPE

The following General Terms and Conditions (GTC) apply to all orders placed via the VALL'DOAIDO website and in the retail store. The offer is exclusively directed at consumers residing in Switzerland (hereinafter referred to as "the customer"). A consumer is considered a natural person who enters into a legal transaction for purposes that cannot be attributed to their commercial or professional activity. Orders in non-household quantities may be rejected without justification.

VALL'DOAIDO reserves the right to change these GTC at any time. The version of these GTC valid at the time of the order is decisive for the respective order. Any terms and conditions of the customer that are contrary to or deviate from these GTC will not be recognized.The operator of the website and the retail store is VALL'DOAIDO GmbH (hereinafter "VALL'DOAIDO").

2. INFORMATION ON THIS WEBSITE

The VALL'DOAIDO website contains information about products and services. Price changes, assortment changes, and technical changes are reserved. All information on the website (product descriptions, images, illustrations, films, dimensions, weights, technical specifications, accessory information, and other information) is for illustration purposes only, should be understood as approximate values, and is not binding. In particular, they do not constitute a property assurance or guarantee unless expressly stated otherwise.

VALL'DOAIDO strives to ensure that all information on this website is accurate, complete, current, and clearly presented, but cannot guarantee this explicitly or implicitly. All offers on this website are non-binding and should not be understood as a firm offer. VALL'DOAIDO cannot guarantee that the listed products will be available at the time of order. All information regarding availability and delivery times is provided without guarantee and may be changed at any time without prior notice.

3.PRICES

The sales prices indicated on the VALL'DOAIDO website are in Swiss Francs (CHF) and are final prices; they include, unless otherwise stated, the statutory VAT and any other statutory charges such as the advance recycling fee (VRG).

Any shipping costs will be charged additionally and are to be borne by the customer, unless the order value exceeds CHF 250.00. The shipping costs are shown separately in the ordering process.

VALL'DOAIDO reserves the right to make technical changes as well as errors and printing mistakes. In particular, VALL'DOAIDO can make price changes at any time and without prior notice. Consulting and support services are not included in the sales prices.

4.CONTRACT CONCLUSION

The products and prices on this website represent non-binding offers.

By placing an order through the website, the customer submits a legally binding offer to conclude a contract, in conjunction with the acceptance of these terms and conditions. VALL'DOAIDO then sends an automatic order confirmation via email, confirming that the customer's offer has been received by VALL'DOAIDO. Orders placed are binding for the customer. Unless otherwise stated, there is no right of return or withdrawal (see section 7).

The contract is concluded as soon as VALL'DOAIDO sends a declaration of acceptance via email, confirming the dispatch of the ordered products or services.

Orders will only be shipped after full payment has been received (exception: delivery on account) and if the goods are available. If it turns out that the ordered goods cannot be delivered or cannot be delivered completely, VALL'DOAIDO is entitled to accept or execute the order only partially or not at all. In this case, VALL'DOAIDO will inform the customer via email. If the customer's payment has already been received by VALL'DOAIDO, the entire amount or only the difference will be refunded to the customer. If no payment has been made yet, the customer will be released from the payment obligation.

5. PAYMENT OPTIONS AND RETENTION OF TITLE

The customer has access to the payment options specified in the ordering process.

VALL'DOAIDO reserves the right to exclude customers from individual payment options without stating reasons or to insist on advance payment.

In the event of customer payment default, VALL'DOAIDO may charge default interest of 5% per year and a reminder fee of up to CHF 20.00 per reminder.

The products delivered to the customer remain the property of VALL'DOAIDO until full payment is received.

6. DELIVERY, DUTY TO INSPECT, NOTICE OF DEFECTS

Deliveries are sent by post or courier service to the address specified by the customer in the order.

VALL'DOAIDO strives to keep delivery times as short as possible.The delivery times stated in the order confirmation are non-binding. VALL'DOAIDO is entitled to make partial deliveries. In this case, the customer will only be charged for shipping costs once.

The invoice will be sent – if delivery on account is offered – at VALL'DOAIDO's discretion by email or by post. If the delivery cannot be made or the customer refuses acceptance, VALL'DOAIDO is entitled, after prior notification to the customer by email and granting a reasonable grace period, to withdraw from the contract; in this case, the customer may also be charged for the costs incurred due to the effort.

The customer is obliged to inspect the delivered goods immediately upon receipt and report any defects for which VALL'DOAIDO is responsible without delay in writing – by letter or email – to the address specified in the imprint. Hidden defects must be reported immediately upon discovery.

In this case, the return to VALL'DOAIDO is at the customer's cost and risk. The customer must send the goods in the original packaging, complete with all accessories, along with the delivery note and a detailed description of the defects including photographs to the address specified in the imprint.

If the inspection by VALL'DOAIDO reveals that the goods have no detectable defects or do not fall under the manufacturer's warranty, VALL'DOAIDO may charge the customer for the costs associated with returning the goods or any possible disposal.

7. CANCELLATION AND RETURN

Under Swiss law, there is no statutory right of withdrawal or return. However, VALL'DOAIDO strives to find a mutually satisfactory solution in case of any issues.

8. WARRANTY

VALL'DOAIDO is committed to delivering their products in the highest quality.It is at the discretion of VALL'DOAIDO to provide the warranty through free repair, equivalent replacement, or refund of the purchase price. Further warranty claims are excluded to the extent permitted by law.

The warranty does not cover normal wear and tear, consequences of improper handling or damage by the customer or third parties, or defects attributable to external circumstances.

For wine products, VALL'DOAIDO will exercise the utmost care in handling the products in their possession, but assumes no liability for the condition of the wine or that its quality meets the customer's expectations.According to the regulations of the Swiss Wine Trade Association, spoiled wine bottles will only be replaced if they are Swiss wines or foreign wines bottled in Switzerland.

Broken or cracked corks can occur at any time when opening bottles. This does not entitle the customer to exchange or return the purchased product.

Damaged corks can occur with all products (spirits, wines, etc.). In the case of cork taint, the bottle must be returned to the address provided in the imprint. The complaint will be professionally reviewed, and if justified, a replacement bottle will be sent. A complaint cannot be recognized if more than 10 cl is already missing.Since a cork taste is quickly identifiable, every customer should briefly taste their wine and immediately note any defects.

Rarities and aged wines are excluded from any return, exchange, and warranty. The customer cannot claim any compensation in this regard.

VALL'DOAIDO does not guarantee the timeliness, completeness, and accuracy of the data, nor the constant or uninterrupted availability of the website, its functionalities, the embedded hyperlinks, and other content.

9. LIABILITY

To the extent permitted by law, VALL'DOAIDO excludes all liability – regardless of its legal basis – as well as claims for damages against VALL'DOAIDO and its auxiliary persons.In particular, VALL'DOAIDO is not liable for indirect damages and consequential damages, lost profits, as well as other property damages and pure financial losses of the customer.

Liability for damages based on gross negligence or intent on the part of VALL'DOAIDO, as well as liability for personal injuries and according to mandatory legal provisions (especially the Product Liability Act), remains reserved.

VALL'DOAIDO uses hyperlinks solely to facilitate the customer's access to other websites. VALL'DOAIDO cannot know the content of these web offers in detail and assumes neither responsibility nor any other liability for the content of these websites.

10.PRIVACY

VALL'DOAIDO processes the data collected during the contract conclusion to fulfill the obligations arising from the purchase contract and – with the customer's explicit consent – for marketing purposes. The data required for service provision may also be shared with commissioned service partners (e.g., logistics partners) or other third parties, as necessary for contract fulfillment. Otherwise, the provisions of VALL'DOAIDO's privacy policy apply.

11.SALVATORI CLAUSE

If individual contract provisions or provisions of these General Terms and Conditions are invalid, ineffective, void, or unenforceable, or become invalid or unenforceable after the contract is concluded, the validity of the remaining contract provisions shall remain unaffected. The invalid or unenforceable provisions shall be replaced by a valid and enforceable provision that comes closest to the economic purpose pursued by the contracting parties with the invalid or unenforceable provision. The above provisions apply accordingly in the event that the contract proves to be incomplete.

VALL'DOAIDO reserves the right to change these GTC at any time. For contracts already concluded, the version valid at the time of the order shall apply.

12. YOUTH PROTECTION

According to legal regulations, wine may not be sold to persons under 16 years of age and spirits may not be sold to persons under 18 years of age. By placing your order, you confirm that the information you have provided is accurate and that you are entitled to make the purchase.

13. JURISDICTION AND APPLICABLE LAW

All legal relationships between VALL'DOAIDO and the customer are exclusively subject to Swiss law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG, Vienna Sales Convention).

The place of fulfillment and exclusive jurisdiction is Balsthal, subject to mandatory legal jurisdictions.
